TERMS OF SERVICE

Overview
These Terms of Service ("Terms") are between you and Prestigious Homeware Pty Ltd (ABN 81 627 749 848), trading as Magnetic Craft ("Magnetic Craft", "we", "us", "our").
We operate this website and online store, including all related content, features, tools, products and services (the "Services"). Our store is powered by Shopify.
These Terms, together with our Returns & Refunds Policy and Privacy Policy, describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights, including limitations of liability.
By visiting, interacting with or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Your consumer rights. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or warranty that cannot lawfully be excluded, restricted or modified under the law that applies to you — including the Australian Consumer Law, the New Zealand Consumer Guarantees Act, the UK Consumer Rights Act 2015 and mandatory consumer protection law in the European Union and elsewhere. Where any provision of these Terms conflicts with such a right, that right prevails.
1. Access and Your Account
By using the Services, you confirm that you are at least the age of majority where you live, or that you are using the Services with the consent and supervision of a parent or guardian.
Our products are designed for children, but our store is intended for use by adults. Purchases must be made by an adult.
You may be asked to provide information such as your email address and billing, payment and shipping details. You agree that the information you provide is accurate, current and complete.
You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell or assign your account to anyone else.
2. Our Products
We take care to represent our products accurately. However, colours and appearance may differ from how they appear on your screen depending on your device and its settings.
Product descriptions and specifications may change without notice. We may discontinue any product and may limit quantities available to any person, region or jurisdiction.
This section does not limit your rights in relation to products that are faulty, unsafe, not as described, or that do not meet a consumer guarantee under applicable law.
3. Product Safety and Supervision
Our products contain magnets and small parts.
Please observe the age grading and warnings on the product and its packaging. Magnets and small parts present a choking hazard, and swallowed magnets can cause serious internal injury requiring emergency medical treatment. If you suspect a magnet or small part has been swallowed or inhaled, seek immediate medical attention.
Our products are intended for supervised play by children within the stated age range. Adult supervision is recommended.
Products should be used only for their intended purpose and in accordance with any instructions and warnings supplied with them.
If we or a regulator issue a safety notice or recall, we will act in accordance with that notice and applicable law. Nothing in these Terms limits your rights in relation to unsafe products.
4. Orders
When you place an order, you are making an offer to purchase. Your order is accepted only when we confirm acceptance and receive and process your payment.
We may decline, hold or cancel an order for legitimate reasons, including where:
- the product is unavailable;
- we identify a pricing or description error;
- we cannot verify payment or delivery information;
- we reasonably suspect fraud or unauthorised activity;
- our carrier, fulfilment provider, payment provider or another service provider cannot lawfully or practically process or deliver the order; or
- fulfilling the order would be prohibited or restricted by applicable sanctions, trade controls, export controls or other law.
If we cancel an order before supplying the relevant goods, we will refund amounts paid for the cancelled goods, except where applicable law prohibits or restricts us from doing so.
Please review your order carefully before submitting it. Cancellation before dispatch is dealt with in our Returns & Refunds Policy.
Returns and refunds are governed by our Returns & Refunds Policy.
These Terms apply to consumer purchases. Wholesale, trade and business-to-business orders are governed by separate terms.
5. Prices, Taxes and Payment
Prices, discounts and promotions may change without notice. The price that applies to your order is the price shown at the time you place it, as set out in your order confirmation.
Import duties, import taxes and customs charges associated with delivery are paid by Magnetic Craft. You will not be required to pay additional import duties or customs charges to receive your order.
If a carrier or customs authority unexpectedly requests such a payment, please contact us before making the payment so that we can investigate.
Prices displayed to customers in Australia include GST where applicable.
Promotions may be governed by their own terms. Where those terms conflict with these Terms, the promotion terms apply to that promotion.
You confirm that you are authorised to use the payment method you provide and that the payment details you give us are accurate.
6. Delivery and Risk
Delivery dates and timeframes shown on our website, at checkout or otherwise communicated to you are estimates unless we expressly state that they are guaranteed.
Delivery may take longer during peak periods, including Christmas and other major holiday periods, and may also be affected by carrier congestion, customs or border processing, severe weather, public holidays, local delivery conditions and other circumstances outside our reasonable control.
A delay beyond an estimated delivery date does not, by itself, mean that an order has been lost or that you are automatically entitled to a refund or replacement, except where applicable law provides otherwise.
We will use reasonable efforts to dispatch orders within any timeframe expressly represented at the time of purchase. If we become aware that we cannot dispatch an order within a timeframe we have represented, we will provide any notice, revised shipping date, cancellation option, consent request or refund required by applicable law.
Risk of loss or damage passes to you when the goods are delivered to the address you provided at checkout. Where applicable law provides otherwise, that law applies.
Lost, delayed and undelivered parcels are dealt with under our Returns & Refunds Policy and applicable consumer law.
7. Errors, Inaccuracies and Omissions
Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.
We may correct any such error and may cancel an affected order, including after it has been submitted. Where we cancel an order for this reason, we will notify you and refund amounts paid for the cancelled goods.
We will not charge you a price higher than the one shown when you ordered without your agreement.
8. Intellectual Property
The Services — including trade marks, text, images, graphics, video, audio and their selection and arrangement — are owned by Magnetic Craft, its affiliates or licensors and are protected by applicable intellectual property laws.
You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish or transmit material from the Services without our prior written consent.
"Magnetic Craft" and our logos are trade marks of Prestigious Homeware Pty Ltd. Other marks belong to their respective owners.
All rights not expressly granted are reserved.
9. Reviews, Feedback and Submissions
If you submit reviews, photographs, videos, ideas, suggestions, feedback or other content ("Feedback"), you grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium, including for promotional and advertising purposes.
You confirm that:
- you own or have the rights necessary to provide the Feedback;
- you have disclosed any payment, free product or other incentive received in connection with it; and
- it does not infringe another person's rights and is not unlawful, misleading, defamatory, obscene or abusive.
We are not obliged to keep Feedback confidential, pay for it or publish it. We may remove Feedback that breaches these Terms.
10. Prohibited Uses
You may use the Services for lawful purposes only. You must not:
- use the Services for any unlawful, fraudulent or malicious purpose;
- breach any applicable law or regulation;
- infringe our intellectual property rights or those of others;
- harass, abuse, threaten, defame or harm any person;
- transmit false or misleading information or impersonate another person;
- send spam or unlawful unsolicited promotional material;
- upload viruses or malicious code;
- unlawfully scrape, crawl, harvest or collect data or personal information; or
- interfere with or circumvent the security or proper operation of the Services.
We may suspend or terminate access where this section is breached.
11. Third-Party Tools, Links and Services
The Services may include or link to tools, content or websites operated by third parties.
We do not control them and, to the extent permitted by law, are not responsible for their independent content, availability, products, services or practices.
Your use of third-party services may be subject to their own terms and policies.
12. Relationship with Shopify
Our store is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase made through our store is directly between you and Magnetic Craft.
Shopify is not the seller of Magnetic Craft products.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising solely from the manufacture, sale or use of Magnetic Craft products.
Nothing in this section limits any right or remedy you have against Magnetic Craft or any right that cannot lawfully be excluded.
13. Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Certain information may also be processed by Shopify and other service providers involved in operating our store, processing payments and fulfilling orders, as described in our Privacy Policy.
14. Disclaimer
General information presented through the Services — including blog content, play ideas and general guidance — is provided for informational purposes only. We do not warrant that such general information is complete or suitable for your particular circumstances.
To the maximum extent permitted by law, the website and other non-product elements of the Services are provided on an "as is" and "as available" basis, and we do not guarantee uninterrupted, timely, secure or error-free availability.
These disclaimers do not exclude statutory rights relating to products purchased from us.
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- liability for unsafe or defective products to the extent such liability cannot lawfully be excluded, restricted or limited;
- breach of any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified; or
- any other liability that cannot lawfully be limited or excluded.
Subject to the above, and to the maximum extent permitted by applicable law:
- we are not liable for indirect, incidental, special, punitive, exemplary or consequential loss or damage, or loss of profit, revenue, business opportunity, anticipated savings, data or goodwill; and
- our total aggregate liability to you arising out of or in connection with a product, your purchase of that product or these Terms, whether arising in contract, tort (including negligence), statute or otherwise, is limited to the amount you paid for the affected product.
Where the Australian Consumer Law applies and a consumer guarantee can lawfully be limited under section 64A of the Australian Consumer Law, our liability is limited, at our option, to:
- replacing the goods or supplying equivalent goods;
- repairing the goods;
- paying the cost of replacing the goods or acquiring equivalent goods; or
- paying the cost of having the goods repaired.
This limitation applies only where it is fair and reasonable for us to rely on it as permitted by law.
Nothing in this section affects your statutory rights as a consumer.
16. Indemnity
To the extent permitted by applicable law, you agree to indemnify us against losses, liabilities, damages and reasonable costs that we incur as a direct result of:
- your material breach of these Terms;
- your unlawful, fraudulent or malicious use of the Services; or
- your infringement of a third party's rights.
This indemnity does not apply to the extent that the relevant loss was caused or contributed to by our negligence, wrongful act, omission or breach.
This indemnity does not apply merely because you purchased or ordinarily used a Magnetic Craft product in accordance with these Terms and the product's instructions and warnings.
17. Suspension and Termination
We may suspend or terminate your access to the Services where you materially breach these Terms, where we reasonably suspect fraudulent or unlawful activity, or where required by law.
Termination does not affect an order already accepted or any statutory refund, remedy or other right to which you are entitled.
Provisions that by their nature should survive termination continue to apply.
18. Changes to These Terms
We may update these Terms from time to time. We will publish the updated version and revise the "Last updated" date.
The version of these Terms published at the time you placed your order is the version that applies to that order.
Changes will not retrospectively reduce rights relating to an order already accepted except where permitted or required by applicable law.
19. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and courts competent to hear appeals from them.
If you are a consumer, this does not deprive you of mandatory protections under the laws applicable to you or any right under applicable law to bring proceedings before another competent court, tribunal or consumer body.
If you have a complaint, we encourage you to contact us first so that we have an opportunity to resolve it.
Nothing in this section prevents you from contacting a regulator, consumer protection authority, tribunal, alternative dispute resolution service or court where you have the legal right to do so.
20. General
No assumption of additional liability. Except as expressly stated in these Terms or required by applicable law, nothing in the Services, our policies or communications creates or constitutes any additional warranty, guarantee, indemnity, assumption of liability or contractual obligation beyond those expressly undertaken by us.
Severability. If any provision is unlawful or unenforceable, it will be severed or modified to the minimum extent necessary, and the remaining provisions continue in effect.
Waiver. Our failure or delay in enforcing a provision or exercising a right does not waive that provision or right.
Entire agreement. These Terms, together with the policies referred to in them and any terms expressly applicable to your order, form the agreement between you and us concerning the Services and your purchase.
Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign or transfer our rights and obligations, provided doing so does not reduce rights that cannot lawfully be reduced.
Headings. Headings are for convenience only and do not affect interpretation.
